VJ Junior, Co-Accused Rubbish Porn Charges

Popular video jockey Mary Smart Matovu VJ Junior has this morning opposed the legality of charges levied against him in court.

VJ Junior and Geoffrey Bossa are facing charges related to sale of Pornography movies before Buganda Road chief magistrate’s court.

They however challenged the charges the State intends to slap on them in the amended charge sheet.

Through their lawyers Tony Kirabira and Naluyimbaazi Nalukoola, they raised Preliminary points of law whereby they claim that the Article of the Anti-Pornography Act in which they are being charged is being challenged in the Constitutional court.

They argued that the amended charge sheet doesn’t clearly provide details of the charges brought against them.

Lead counsel Nalukoola pointed out that on the amended charge sheet they have charges brought under Section 13 of the Anti Pornography Act

2014, which is being challenged by the Center for Domestic Violence Prevention and others in their constitutional petition number 13 of 2014, which has never been disposed off to date.

“We are so concerned that court may convict the accused persons basing on the Challenged Act, which we ask court to consider  before proceeding with this case,” Nalukoola said.

Nalukoola later challenged the Uganda Communications Commission Act of

charging somebody for operating without its operation license yet he had a license from Kampala Capital City Authority, which is another government organ.

“The amended charge sheet is not well detailed as required under section 5 of the Magistrates’ court Act. Failing to give particulars of the offence of infringement contrary to section 46 and 47a of Cooperate and Neighboring Act 2005 doesn’t show whose rights were infringed and what authorities he had to reproduce this material,” added Nalukoola.

The state prosecutor Jonathan Muwaganya, before replying to these submissions, asked the applicants’ lawyers to serve him with authenticated court documents on the Authorities they have cited in court.

Buganda Road court chief magistrate James Mawanda Eremye adjourned the matter to September 17th,  2017 for the state’s reply.

VJ Junior is charged with sale of Pornography Contrary to section 13 of the Anti-Pornography Act.

Prosecution alleges that on May 23rd, 2017 at Q’s studio on Majestic Plaza Kampala district, Junior sold a

pornographic movie titled ‘Fifty Shades of Grey’ to Ntambi Frank, intending to corrupt his morals.

Bossa is also charged with sale of Pornography whereby prosecution alleges that on May 23rd, 2017 while at Zai Plaza Shop No FF3 in the Kampala District SOLD 4 Pornographic movies titled ‘Tarzan’, ‘Lie With Me’, ‘Endless Love’ and ‘Impulse’ to No. UPF 39301 D/CPL Namuganya Aisha.
